Laws Governing HOAs

In addition to a property owners’ association’s dedicatory instruments (governing documents), federal, state, and municipal laws exist that require adherence by the Corporation (HOA), its Directors, Officers, and Members.

Those that I have identified are linked to below; this is not guaranteed to be a complete list of all applicable laws that govern HOAs.

Texas Property Code, Title 11, Chapters 201-215

Two chapters that are most referred to in this Code are:

  • Chapter 202: Restrictive Covenants & Association’s duty to file dedicatory instruments with the county, and
  • Chapter 209: Texas Residential Property Owners Protection Act includes board governance, elections, voting, right to access records, and other topics important to homeowners (HOA Members)

Texas Business Organizations Code, Chapter 22
