In April 2025, two homeowners (currently, Board members) filed suit against the HOA asking to reconvene the election from January 2025, which was adjourned without a quorum or a certified vote.

12/11/2025 After many postponements of trial dates, the Harris County court records set a trial date for December 9, 2025, as requested by both parties, hoping to come to a settlement. Several homeowners (HOA Members) were prepared to go to court to witness the proceedings. But, in the morning, before the 1:00 trial time, the court’s public records were updated – stating that the parties had reached a settlement; the trial was rescheduled for January 12, 2026, allowing time for the HOA’s Board to vote on approving the settlement and file for dismissal of the case. Although an email blast announced to HOA Members that the case has been dismissed, as of 1:00 a.m., Friday, 12/11/2025, the publicly available court records online do not yet reflect that.
10/17/2025 Complying with the court order, the election was reconvened in July. Subsequently, a recount of ballots took place in August. The two plaintiffs are now on the Board.
“The case is not about the money,” they have said. They just want to help WWV. Lately, they have told us the suit has been dismissed.
BUT that is not quite true. Court records are publicly available online and, as of mid-October, show a trial set for December 9, 2025. The attorney for WWV hopes to reach a settlement by then, according to their Agreed Motion for Continuance. Now, to me, the trial date means the case has not been dismissed, and “settlement” means money.
The Plaintiffs cannot represent themselves AND WWV in settlement negotiations; that would only add to the current conflict of interest of their being on the Board with their lawsuit pending.
The Plaintiffs also have said that if any settlement is awarded, WWV and, ultimately our monthly assessments, will not have to pay for it. Rather, the insurance company will pay. But have you ever filed an insurance claim and NOT had your premiums increase or your policy canceled?
